
A West Bend man is only facing one charge after allegedly hitting two people involved in an accident in Fond du Lac County on New Year’s Eve.
The fatal crash happened on US 45 near Sandy Road and ended up ejecting four people. 19-year-old Jatziel Encarnacion then allegedly struck two people, hitting one in the head and then hitting and dragging Taya Grimes for several miles.
However, the charges filed Thursday (January 18th) were only related to the victim being hit in the head. When asked about Grimes,
Fond du Lac County District Attorney Eric Toney says, “As prosecutors, we must be able to prove our cases beyond a reasonable doubt, and when you have injuries that may occur, you can’t prove when those injuries may have happened. Or, if the evidence suggests they may have occurred before something, it becomes difficult to tell a jury that they should find somebody guilty beyond a reasonable doubt, based on those circumstances.”
Encarnacion is facing a charge of hit-and-run causing great bodily harm.
No charges have been filed related to underage drinking that might have caused the crash.
