This week, the state’s abortion statute will be challenged by the attorney general of Wisconsin.
Attorney General Josh Kaul will make an argument in opposition to the 1849-era law.
Kaul, a pro-abortion candidate for re-election, is anticipated to make the case that Wisconsin lawmakers tried to amend the existing statute, demonstrating their intention to legalize abortions in the state.
Abortion is only legal in Wisconsin under the 1849 abortion statute if it saves the mother’s life.
On Thursday, the case is scheduled to be heard in Madison.
