
The teen who was convicted in the death of 7-year-old Ethan Hauschultz is appealing the decision.
Damian Hauschultz was convicted on a charge of 1st Degree Reckless Homicide after Ethan died from hypothermia and blunt force injuries in 2018, but his defense team claims statements he made at 14 years old should not have been admitted in court.
Damian’s lawyer claims that he was questioned three times, and each time the officer failed to give the Miranda warnings.
The court disputed this, saying that Damian was not in Miranda custody at the time of the questioning.
Damian’s mother, 39-year-old Tina McKeever-Hauschultz was sentenced to 5 years in prison on child abuse charges, while his father, Timothy Hauschultz is awaiting trial.
His case is pending until Damian’s case is closed, as Damian will be a witness in Timothy’s case.
