
Attorney General Josh Kaul has named new defendants in his lawsuit to block the enforcement of Wisconsin’s 1849 abortion law.
Kaul on Friday removed three Republican legislative leaders from his lawsuit to block enforcement of the law, replacing them with the district attorneys from Dane, Milwaukee, and Sheboygan County as defendants.
Those three counties are the only locations in Wisconsin where abortions were performed prior to the U-S Supreme Court overturning Roe V Wade this summer.
The DAs have 45 days to respond.
The legislative leaders were Senate president Chris Kapenga, Majority Leader Devin LeMahieu, and Assembly Speaker Robin Vos.
They argued they were not responsible for enforcing the law.
