The Fond du Lac man who was convicted this week in the death of Phillip Thiessen two years ago is not going to prison.
A jury has determined that Daniel Navarro, whom they had just declared guilty of 1st Degree Intentional Homicide, should be committed to a mental health treatment facility in lieu of jail.
The jury said that while he did kill Thiessen, Navarro’s mental health issues prevented him from knowing what is right and wrong and thusly could not stop himself from ramming his vehicle into the back of Thiessen’s motorcycle.
Two doctors had testified in court that Navarro suffers from schizophrenia and that at the time of the crime he was “out of touch with reality.”
Navarro is being committed to the custody of the Wisconsin Department of Health Services and can petition the court for a conditional release in six months.
