
The 17-year-old male who was arrested in connection to the East River Trail attack has been bound over for trial.
While in court on Wednesday (November 17th) Brown County Court Commissioner Paul Burke determined there is enough probable cause in the case against Miles Cruz to order him to stand trial.
Cruz has been charged with 1st Degree Sexual Assault Causing Great Bodily Harm, Kidnapping, Strangulation and Suffocation, 2nd Degree Recklessly Endangering Safety, and Attempted 1st Degree Intentional Homicide.
The defense filed a motion to have the attempted homicide charge dropped, claiming there was never any intent to kill the victim.
District Attorney David Lasse disagreed, saying that Cruz had left the victim motionless 150 feet off the trail, and likely believed he had killed her.
The motion was denied. Cruz will be back in court on December 6th.
