The Wisconsin Supreme Court has denied a petition to review the Steven Avery case.
Avery’s attorney Kathleen Zellner filed the petition back in August but said she is not surprised the highest court in Wisconsin denied it.
She cited the fact that only about 2% of petitions like this one are actually granted.
But, Avery’s team is not through, as Zellner said she will be filing another petition, this time with the Circuit Court.
This setback for the Defense is just the latest in a long line of setbacks, with the most recent coming back in July when an appellate court denied an evidentiary hearing.
Avery is currently serving a life prison sentence for the murder of Theresa Halbach in 2005.
