
Steven Avery is once again appealing a court decision, and this time he is petitioning the state’s highest court.
Avery’s attorney Kathleen Zellner filed the petition to the Wisconsin Supreme Court on Wednesday (August 25th), arguing that Avery had ineffective assistance of counsel during his trial, and cited Brady Violations, and Destruction of Bone Fragments.
According to the Cornell Law School website, the Brady Rule “requires prosecutors to disclose materially exculpatory (ex-cul-pat-or-ee) evidence in the government’s possession to the defense.”
Or in layman’s terms all evidence, even that which would prove the suspect’s innocence, must be presented by the prosecution.
A court response is due by September 9th.
