Prehn says a lawsuit aimed at removing him from that panel is politically motivated.
Democratic Governor Tony Evers appointed Sandra Nass to replace Prehn, but the Wisconsin Senate has never confirmed her.
Prehn has pointed to a state law that says he can remain until his replacement is confirmed.
Prehn was appointed by Republican Governor Scott Walker five years ago.
Democratic Attorney General Josh Kaul filed the suit Tuesday.
