
A Green Bay man who is currently in prison for a 2017 shooting incident, had his appeal request denied.
20-year-old Bryant Ellis was attempting to withdraw his no-contest plea for the 2017 shooting of Andrew Tohulka.
Ellis admitted to drinking and smoking marijuana with Tohulka prior to the shooting. The two were reportedly playing with a handgun, when it went off, killing Tohulka.
Ellis claims the court did not do the proper questioning, that his plea wasn’t voluntary, and that his attorneys didn’t properly handle a presentencing psychological evaluation.
The court denied Ellis’ request, saying he “failed to show by clear and convincing evidence that it would be manifestly unjust to disallow his plea withdrawal.”
Ellis is currently serving a 20-year sentence.
