Lawyers for former police officer Michael Mattioli say he can’t get a fair trial in Milwaukee County Circuit Court.
The judge says she isn’t ready yet to make a ruling on their request for a change of venue.
Mattioli is charged with first-degree reckless homicide.
Prosecutors say he used a chokehold on Joel Acevedo after a party in the officer’s home last April.
The case log caused by the coronavirus pandemic means the earliest his trial could be scheduled is in July.
He returns to court next month for another hearing.
