17-year-old Damian Hauschultz was in Manitowoc County Court yesterday, where it was determined that statements, he made to the Police will be used in court.
Hauschultz is facing charges after allegedly causing the death of 7-year-old Ethan Hauschultz in April of 2018.
In court yesterday, Judge Jerilyn Dietz determined that statements made by Damian on the day of Ethan’s death and one given months later would be allowed to be used in court.
The defense claims that Damian had not been read his Miranda Rights before giving them, but Judge Dietz said that he was not in custody at the time, therefore they were voluntary.
A trial date is expected to be scheduled during a December 17th hearing.
Damian’s father, Timothy Hauschultz, and his wife Tina McKeever-Hauschultz are also facing charges in the child’s death.
