The Wauwatosa Police and Fire Commission will begin the process of deciding whether Officer Joseph Mensah gets his job back next month.
An evidentiary hearing has been set by the commission for December 16th.
Although he has been cleared of criminal charges, Mensah could still face discipline.
A former federal prosecutor, Steven Biskupic, has recommended that Mensah be fired, saying the risk he might kill a fourth person is too high.
The officer has been on the job for five years and, in that time, has killed three people.
