Election officials in Outagamie and Calumet counties have been told to put the felt-tip markers away as they try to deal with a misprint on more than 13,000 ballots.
The Wisconsin Supreme Court refused to let the counties take steps to process those ballots more quickly without needing to duplicate them on Election Day.
Four conservatives on the state court rejected the request, while three liberals dissented.
They said the decision “leaves local election officials in the lurch.”
