The Wisconsin Appeals Court is being asked to overturn a Monday ruling by Barron County Judge James Babler.
The fight over Governor Tony Evers’ emergency order limiting how many people can gather in bars, restaurants, and other indoor locations isn’t finished yet.
An Amery bar and Pro-Life Wisconsin are asking the court Tuesday to overrule Judge Babler.
They have requested a ruling by Friday – only two weeks before the emergency order is set to expire on its own.
The Tavern League of Wisconsin is also expected to go to the state appeals court.
Those fighting the order say the governor should have gone through the Legislature to issue an administrative rule.
