The Wisconsin Supreme Court has decided the Green Party waited too long to file a challenge against the ruling that is keeping its candidate off the ballot.
Conservative Justice Brian Hagedorn joined with the court’s liberal justices Monday on the four-to-three vote.
Democrats worried the presence of Green Party presidential candidate Howie Hawkins would take enough votes from former Vice President Joe Biden to give President Trump Wisconsin’s electoral votes.
Trump won the state in 2016, but by less than 23,000 votes.
The court also vacated an earlier order Monday, allowing local officials to mail out absentee ballots now.
