A Wisconsin appeals court has rejected a request from two airlines that they get a refund of $4.2 million they paid in taxes.
Southwest Airlines and Air Tran Airways filed a suit after merging in 2011 arguing they flew enough flights to qualify as hub facilities under Wisconsin law. That law offers a tax exemption.
The 1st District Court of Appeals handed down its ruling Tuesday, saying the two airlines didn’t have enough flights out of the Dane County Regional Airport to qualify for the exemption.
