
Due to the media coverage surrounding the case, the lawyer of 49-year-old Timothy S. Hauschultz says his client cannot receive a fair trial for his role in the death of 7-year-old Ethan Hauschultz.
Attorney Donna Kucher filed an eight-page motion to Judge Jerilyn Dietz, citing near 20 stories published in the Herald Times Reporter, as well as other coverage both in and out of the state, saying they portray him “in the worst possible light.”
Kucher also claims that Sheriff’s officials illegally searched the home, after Timothy revoked his consent. She claims the officers took “numerous items…including pieces of wood and a shovel used in the alleged offense.”
Timothy is accused of ordering his adopted son, Damian to force Ethan to perform a punishment, which included carrying a 44-and-a-half-pound log around the yard for around two hours.
Timothy is facing eight charges including Felony Murder, and several variants of child abuse.
