A state appeals court has denied the appeal of a man who was convicted of a 2013 murder in the Town of Oneida.
Alejandro Silva was convicted of 1st Degree Intentional Homicide in 2015, but he was seeking a new trial claiming “juror misconduct” and claims that the jury was misled during instructions.
In August of 2013, Silva had gotten into a fight with Kamewan Salzman outside of Benderz Bar in Oneida.
Silva reportedly fired four shots, one of which ricocheted off the pavement, and entered Salzman’s heart.
During his trial, Silva’s defense team claimed the shots were in self-defense, and that there was no intent to kill.
Silva is currently serving a life sentence in state prison.
