The Wisconsin Department of Justice is calling for the appeal in the case of Steven Avery to move forward following several delays. Avery’s attorneys filed a motion last Thursday questioning if the state violated his right to due process by giving suspected human bones to victim Teresa Halbach’s family. Avery was convicted of Killing Halbach back in 2005, and had until February 1st to file for an appeal. While the DOJ welcomed the appeal, but also stated, “It is inappropriate…for Avery to continue to ignore the Wisconsin rules of procedure …and perpetually delay this appeal by repeatedly seeking remand for litigation of issues unrelated to the circuit court’s denial of his motions.”
